Apple appeals UK competition watchdog to investigate mobile browser dominance

Report Reuters: Apple has appealed against the UK's competition watchdog over its dominance in mobile browsers on the cloud gaming market. The Competition and Markets Authority began investigating the dominance of Google and Cupertino.

Apple lawyers believe that the investigation should be reopened as CMA failed to meet timing requirements for the launch of an inquiry.

"Apple requests 1) an Order to annul the MIR Decision. 2) A declaration that the MIR Decision, and the market investigation purportedly initiated by reference to it, are null and without legal effect," the Appeal Tribunal filed.

CMA on the other side said that it will defend its position because it "opened this inquiry to ensure that UK consumers have a better choice in mobile web services and that UK designers can invest in innovative, mobile content and services."

According to the Competition Appeal Tribunal website there will be a preliminary hearing on Tuesday regarding mobile browser dominance.

Background

The UK's Competition and Market Authority began investigating in November whether Apple and Google had an "effective" duopoly over the mobile ecosystem. This "allows them to exert a stranglehold on operating systems, app shops, and web browsers on their mobile devices."

This investigation is based upon the Mobile Ecosystem Market Study report. The UK's watchdog found that 97% of mobile web browsing in Great Britain was done using browsers powered either by Apple's or Google browser engines in 2021. This means that any restrictions on these engines could have a significant impact on the users' experience.

There are currently more than 800,000. UK users of cloud gaming services. According to the CMA survey, which included web developers, browser vendors, and cloud gaming service providers alike, Apple and Google are "harming their business, slowing innovation, and adding unnecessary cost."

The CMA believed at the time that these restrictions would limit choices and make it harder to provide innovative apps to UK customers.
